The plaintiff was a 56 year-old male from Spotswood, NJ who fell 20 feet at a residential housing construction site. As a result of the accident, the plaintiff suffered rib and back fractures, which required immediate surgery.
The jury found the defendant 85% negligent as they did not comply with OSHA standards and regulations. They failed to have any fall protection such as guardrails as the plaintiff’s expert argued. The plaintiff was represented by James Pagliuca of Gill & Chamas in Woodbridge, NJ. Andrew Chambarry, ESQ also assisted Mr. Pagliuca on this case, which last six days on trial before the Honorable Lisa M. Vignuolo.
