A Union County jury awarded a verdict of $1,127,941 for a woman who slipped and fell due to snow and ice in a Walmart parking lot. Paul Caliendo of Gill & Chamas represented the plaintiff, who went with her son to the Union Walmart in the middle of a January afternoon.
The Plaintiff testified that she did recall it snowing on and off on the day of the accident and does not recall seeing any type of snow or ice remediation at the Walmart prior to her slip and fall.
The Plaintiff’s weather expert testified that on the day of the incident light snow began around 11:30am which mixed with sleet and rain for the first hour. Thereafter steadier snow fell from approximately 1:30 – 3:00pm.
As a result of this slip and fall, the plaintiff suffered low back injuries and utimately underwent a lumbar microdisectomy and foraminotomy decompression at L4-5 and L5-S1.
A Jury trial commenced in Union County on 1/9/2023 and concluded on 1/19/23 in front of The Honorable John G. Hudak with a verdict as follows:
The Jury found Walmart negligent unanimously (7-0) and that such negligence was the proximate cause of the accident.
