In what attorneys say could be the first case of its kind, a jury this week returned an $8 million verdict against Evenflo Co. Inc. for the wrongful death of a 7-month-old girl in 2010.
A San Mateo County jury of six women and six men ruled Thursday that a mattress pad manufactured by Evenflo suffocated Abigail Karow after a daycare provider put her down for a nap face-down.
Tiffany and Dave Karow, of San Carlos, argued in their lawsuit that their daughter, Abigail, suffocated to death on a mattress pad manufactured by the company because she couldn’t breathe through the material.
Abigail was found face down and unresponsive in an Evenflo Baby Go Madison play yard on April 21, 2010. After 36 hours on a respirator, she was pronounced dead.
